The rebellion lasted for less than half an hour and resulted in the deaths of at least 27 people, the majority of whom were rebels. A spark ignited. On October 6, , two drunken Scots disturbed the publican of the Eureka Hotel, James Bentley, and asked for a drink. In the ensuing confrontation, one of the Scots, James Scobie, was kicked and clubbed to death.

The miners refused to cooperate, and burned their licences and stoned police. On 30 November, miners gathered under the Eureka flag and elected Peter Lalor as their leader.

As a reaction to the acquittal, the miners rioted and set fire to The Eureka Hotel which consequentially burnt down.
